HOW TO PARTICIPATE

The “Create your own party” dynamic is organized by PH Original SAPI de CV., hereinafter “the Organizer”, whose address is C. Sierra, Supermanzana 3, 77500 Cancun, Q.R. This dynamic will be subject to the following bases for participation:

Any person who wishes to participate in the “Create your own party” dynamic, must do so in accordance with the following bases for participation. By participating, it will be understood that you have fully read and understand these participation terms and agree to comply with them in their entirety.

All participants declare and accept that their entry into this dynamic is of their own free will and under their own responsibility. The Organizer will not be held responsible in any way for non-compliance of participants in reference to the bases for participation, nor in the terms and conditions of Facebook.  

1. Participants and participation requirements.

Participants:

• People over 21 (twenty-one) years of age.
• People residing in the US, Canada, and Mexico.
• People with valid official identification.
• People capable of proving their identity with supporting documents (INE, ID, or passport).
• People with a valid passport at the time of registration and travel period (in the case of US and Canada residents).

Those who may not participate:

A. Relatives of Original Group employees, up to the third degree.
B. People who do not fully meet the aforementioned requirements.

2. Length of the dynamic:

The length of the dynamic is from June 5, 2023, 1:00 p.m., Mexico City time, through June 16, 2023, 12:00 p.m., Mexico City time.

3. Mechanics of participation:

The participation mechanism has (2) two phases, which are detailed below:

PHASE 1: REGISTRATION

Start: June 5, 2023, at 1:00 p.m., Mexico City time.

Finish: June 15, 2023, 12:00 p.m., Mexico City time.

1. Take a well-lit full-body photo representing your ideal daytime pool party in the most creative, fun, and unique way. This photo must fulfill the following requirements:

• • The participant must be accompanied by the person with whom he/she will attend the pool party (that person cannot be changed later).
  • Both must appear full body in the photo (participant and companion).
  • Participants must be wearing clothing based on their theme.
  • Include decorative elements (example: inflatables, toys, etc).

2. Enter the Temptation Cancun Resort Facebook page: (facebook.com/TemptationCancunResorts), follow the page, and search for the publication of the “Create your own party” dynamic.

3. Upload your photo in the comments of the post. You must specify the name of your ideal pool party with the theme, activities included, and its dress code, using a minimum of 12 words and a maximum of 25. Use the #LetsPlay hashtag, and tag your travel companion.

IMPORTANT

Photographs that may put the reputation of the Organizer at risk, that go against third parties, or in which actions are committed that go against morality and good customs, will not participate. Among these actions are:

• Consumption of illicit substances
• Consumption of alcohol and other narcotics
• Vices
• Bets
• Nudity
• Animal abuse
• Bullying
• Anything or situation that damages the physical or moral integrity of a person

*The Organizer will automatically discard any photo that does not comply.

Only (1) one registration in which (1) one photograph is attached in the publication of the dynamic on Facebook will be accepted. If the same participant or companion is found with more registrations, only the first registration will be considered as valid, subsequent ones will be discarded. 

PHASE 2: PARTICIPATION

Start: June 5, 2023, at 1:00 p.m., Mexico City time.

Finish: June 15, 2023, at 12:00 p.m., Mexico City time.

During this period, participants must collect the largest number of reactions in the comment that includes their participation in the publication of the “Create your own party” dynamic.

For the participation to be valid it is necessary to comply with:

• All the conditions and requirements of Phase 1.
• The photograph must have good lighting, be original, and meet the conditions mentioned in Phase 1.
• Include the hashtag mentioned in Phase 1, the explanation of the pool party, and the tag of your travel companion. 
• The use of bots to collect reactions is strictly prohibited; in the event that any of the participants are caught using them, they will be automatically disqualified.
• The final choice of the winner is final; the Organizer disclaims the responsibility of showing records or screenshots of the contest tool to verify the selection of the winner. 

PHASE 3: CHOICE OF THE WINNER

Start: June 15, 2023, at 1:00 p.m., Mexico City time.

Finish: June 16, 2023, at 1:00 p.m., Mexico City time.

• The user with the highest number of reactions to their participating comment/publication will be proclaimed as the winner.
• The reactions of the photographs, with their comments, that meet the requirements will be counted on June 15, 2023, at 1:00 p.m. Any reaction that is included afterwards will no longer be counted or valid for participation.
• In the event of a tie, a jury selected by Original Group will select as the winner the comment/publication that they consider to be the most creative, who will be the ultimate winner.
• The Organizer disclaims the responsibility of showing records or screenshots of the contest platform to verify the selection of the winner. 

IMPORTANT: 

The publication of the winner will take place on June 16, 2023, at 1:00 p.m., Mexico City time, on the official social networks of Temptation Cancun Resort (Facebook, Instagram, and Twitter).

4. Winner:

There will be a single winner, and it will be the one with the highest number of reactions complying with the dynamics bases.

5. Prize:

• Daytime pool party at the Sexy Pool, featuring the winning theme.
• An all-inclusive stay at Temptation Cancun Resort for 2 people, 3 days/2 nights in a Trendy Garden View room.  Note: the winner will be contacted to arrange travel dates for the pool party.  
• Round trip airfare for 2 people.
• $500 USD in resort credit to be consumed during the stay.
• Special discount for friends in case additional people would like to travel with the winner.

Important information regarding the prize:

• It is valid for the travel dates established by the Organizer only.
• The prize will be valid for the participant and travel companion included in the participating photo.
• The participant will be given a promo code to book on the official website, temptation-experience.com, which will have a discount of XXXX for their companions. Valid only to book within the travel period established by the Organizer.
• The prize will be subject to the Organizer’s choice.
• The winner must provide a copy of their official identification.
• Prizes cannot be invoiced and cannot be exchanged for cash.
• Prizes are non-transferable.
• Personal expenses or any other not specified in this description are not included.
• Extraordinary expenses are not included, such as transportation expenses to and from the resort.

In the event that the winner rejects the prize, or if the bases of participation of the dynamic are violated, the winner will lose the prize and the Organizer may choose another winner. 

6. Delivery of prize:

The winner will be contacted by email digital@original-group.com to coordinate the delivery of the prize, which will take place respecting the indicated dates of the reservation and travel period marked in point number 5.

7. Prize waiver:

The Organizer will not be responsible if the winner cannot receive the prize due to causes or events of force of majeure or if the winner waives the right to accept it, losing in both cases all the rights they may have in relation to the prize.

9. Intellectual property rights:

By participating in the dynamic, participants guarantee and confirm that all rights, licenses, consents, and permissions are granted to the Organizer for the use of their photo(s) and/or video(s) and that of the third person or companion(s), so that the Organizer and its affiliates and licensees can make the greatest possible use of your photos and/or videos. If any such consent, permission or any authorization has not been regularly and legally obtained, then the entrant, by submitting the photos and/or videos, agrees to indemnify, and hold the Organizer and its affiliates and licensees fully indemnified for and against any claim, damage, loss (foreseeable or otherwise), liability or cost including reasonable attorneys’ fees arising from any failure to obtain consent. 

By participating in the dynamic, participants agree that the Organizer and its affiliates and licensees will have the exclusive right to use their photos and/or videos for promotional purposes, in perpetuity throughout the world and in any media without payment or other type of compensation.

By participating in the dynamic, the winning participant gives consent to share with the Organizer and its affiliates and licensees the photo(s) or video(s) of the won trip, for promotional purposes in perpetuity throughout the world, and in any medium without payment or other compensation. 

By participating in the dynamic, the participant agrees that if the photos and/or video(s) do not meet the technical, artistic, or legal specifications contained in this document, or if the Organizer at its sole discretion requires, will have the right to disqualify any type of photo and/or video. In addition, the Organizer and its affiliates and licensees will have no obligation to return the photos and/or videos or give explanations of why it was disqualified. 

By participating in the dynamic, the participants agree that the Organizer and its affiliates and licensees will be under no obligation to exploit, distribute and/or display any photo and/or video and the participants may not claim against the Organizer and its affiliates and licensees in this regard.

By participating in the dynamic, the participants acknowledge that they may be required to be used in advertising without consent or payment. This advertising may include, but not limited to, the photograph of the participant, and the name and/or image of it, biographical information provided by the participants/winners, and/or any statement made by them in relation to the dynamics and/or prizes. Entrants agree that any or all of these items may be used by the Organizer and its licensors in any and all media in perpetuity throughout the world as Organizer and its licensors in their sole discretion see fit; however, the Organizer and its licensees shall have no obligation to include a participant in any advertising of any kind. 

The undersigned, with the legal and sufficient capacity to participate in the “Create your own party” dynamic, by my own personal right, manifest that I freely and voluntarily participate in the “Create your own party” dynamic, for which that my participation constitutes my express authorization in favor of PH Original SAPI de CV., hereinafter “Temptation Cancun Resort” and/or “Original Group” and/or “Temptation Resorts”, so that directly or through authorized third parties for the latter, to use, publish, disseminate and exploit my name, image, and voice in the advertising of Temptation Resorts products, and in the generation of various content for various Temptation Resorts channels, including but not limited to YouTube, Facebook, Twitter, TikTok and Instagram, television and mass media, under the terms determined by Temptation Resorts for promotional purposes in Mexico and abroad by any means, whether printed, electronic, or any other. In connection with the use of my likeness in such materials, I authorize Temptation Resorts to use my likeness and voice, and its partial or total reproduction in any medium.

By virtue of which, I express my express consent in terms of article 87 of the Federal Copyright Law, for my portrait and/or image to be used or published by Temptation Resorts, in any reproduction, transmission, or retransmission of my image in the promotion content carried out by Temptation Resorts, or any of the companies contracted for such purposes, and the fixing of the same in projections, video, graphics, texts, and all material in which Temptation Resorts uses my image for said advertising purposes. 

Likewise, I grant Temptation Resorts the broadest settlement that is applicable by law and hereby release Temptation Resorts and/or PH Original SAPI de CV., as well as its subsidiaries, affiliates, representatives, administrators, managers, directors, shareholders, and anyone acting on their behalf, regarding any claim of the nature that is derived from the use of my name/image/portrait, and I waive any right that may correspond to me regarding the revocation of this or any future payment of amount, in consideration, or any royalties that could correspond to me for the use of my name, image, and the use of my voice.

10. Privacy policy:

PH Original SAPI de CV. and/or a third party assigned by PH Original SAPI de CV as responsible for the treatment, undertakes to maintain strict confidentiality of the personal data of the participants, it will not be responsible for the eventual dissemination of the same by persons outside the company, nor will it be responsible for any damages that such circumstance generates. 

The personal data, your physical image (photograph and/or video) that users provide, will be incorporated into a database owned by PH Original SAPI de CV. Registered users unconditionally consent to the use and processing of the data provided, in addition to the purpose of participating in the dynamics, for research, promotion, and marketing of the services and products of PH Original SAPI de CV. These data may be made available to other shareholder, related or affiliated companies for the same purposes. Thus, in accordance with the provisions of Mexican legislation, your consent for the processing of personal data as well as your physical image, provided exclusively for the aforementioned purposes, is understood to be granted unconditionally. 

Thus, PH Original SAPI de CV declares that the data provided will be treated in a totally confidential manner and, according to all the security measures established by law, in order to avoid unauthorized access and treatment as established by the Federal Protection Law of Personal Data in Possession of Individuals and our Privacy Policy, which you can consult at: https://m.temptation-experience.com/resorts/temptation-cancun-resort/privacy-policy/

11. Legal conditions:

A. By the mere fact of participating, the participants accept the participation bases described in this document, and their participation in it will mean that they are aware of and submit to these present bases.
B. The bases of participation, mechanics, and restrictions are not appealable, nor are they subject to negotiation or modification of any kind, and the Organizer reserves the right to make any type of change without prior notice; therefore, the participant agrees to periodically review the bases of participation during the period of validity of the dynamic.
C. Due to the above, the Organizer reserves the right to interpret, modify, change, cancel, prolong, decrease, postpone, or annul the validity, requirements, terms, and conditions; likewise, the prizes to be delivered only with the mere mention in the participation bases of these changes or if, in the opinion of the Organizer, there are elements that prevent their realization.
D. The Organizer will not be responsible for any damage, loss, expense, prejudice, or disappointment caused by having participated in the dynamics or by accepting the prize.
F. The Organizer will not be responsible for damages or losses made to your computer, or that of third parties, for having been used to participate or to download any material related to the dynamics.
G. The Organizer will not be responsible for any costs associated with the prize or that are not specifically included in the prize (including but not limited to, the travel visa).
H. The present bases of participation of the dynamics will be regulated and will be interpreted in accordance with the laws of Mexico and the city of Cancun, Quintana Roo.
